I sent this because it seems if your lawyer is from cali, you have some legs to stand on courtesy of the legal rules of the state. Hope it can be used by others to help yourself.
I am writing to you today with a profound sense of disappointment. Throughout this entire process, I have made every effort to be kind, patient, and professional with your staff. I have praised your firm’s work in the past, but the current situation has made me deeply regret that trust.
As a survivor in the Scouting Settlement Trust, I-and the rest of the BSA claimants-have endured enough. We do not deserve to be consistently revictimized by the very people who claim on their website to "treat clients with the respect and dignity they deserve." The ball has been dropped, and the gap between your firm’s public mission and my current experience is unacceptable.
The February 2026 Trust Update confirmed that the $1.65 billion escrow funds were released on February 11. I selected Option 3 (Certification Pathway) specifically to bypass the global lien search. Per the Trust guidelines: "If you select the third option... the Trust will not reserve funds from your distribution." Despite this, your firm is withholding my funds while waiting on LitPRO LLC. As I have informed you repeatedly, I never attended boot camp and have zero Tricare usage; LitPRO is chasing a ghost.
I am asserting the following under California Law:
California Rule of Professional Conduct 1.15(e): You are required to promptly distribute any portion of funds not in dispute. Even if you wrongly insist on a 1.7% holdback, the remaining 3% of this distribution is undisputed.
The 45-Day Presumption: It has been 90 days since the escrow funds were released. Holding undisputed funds past the 45-day mark creates a rebuttable presumption of misconduct in California.
Failure to Supervise (Rules 5.1 & 5.3): You are responsible for the conduct of your staff and your vendor, LitPRO. The inaccurate "scripts" provided by your paralegals contradict the Trust documents and are causing me active psychological harm.
I am done being told to wait for a process I legally opted out of. I demand a written distribution accounting and a wire confirmation for my undisputed funds within 48 hours. If this is not resolved, I will proceed with a formal grievance to the State Bar of California for violations of Rules 1.15 and 1.4. I will also be filing a consumer complaint with the North Carolina DOJ regarding LitPRO’s negligence. I would prefer to resolve this as the professional partners we started as, but I will not allow this firm to continue revictimizing me through administrative delay.
