BSA Settlement Trust — May 2026 Update

Where things stand: 59,410 claims determined, $593 million distributed, combined distributions at 4.7% of allowed claim values. Second distributions processing weekly for claimants who returned lien election forms.
The news most survivors are missing: The Texas insurer litigation is accelerating. Three insurers settled in April alone — Cincinnati Insurance, Amerisure, and SPARTA — the fastest settlement pace in the entire case. Liberty Mutual is signaling settlement. AIG entities just withdrew their jurisdictional defenses, the identical move Amerisure made two weeks before settling. Mediation under former Chief Judge Barbara Lynn is producing real results.
What this means for you: The court has validated $4.2 to $4.4 billion in insurance rights held by the trust. Every settlement adds to your distribution pool. At realistic recovery rates, total trust assets could reach $3.7 to $4.3 billion — producing a final payout of 50 to 60 cents on the dollar of your allowed claim value across all distributions.
The 15% figure is a snapshot, not a conclusion. It reflects early distributions from a trust that is far from finished.
Watch May 13. Judge Silverstein rules on the FCR reserve dispute — the decision that determines the size of your next distribution.
Stay patient. The math is moving in our direction.

Fee split with an unknown second law firm

I was just reviewing my retainer agreement with the firm representing me and found that there is a 50/50 fee split with a firm I have never spoken to or heard of. I feel like an idiot for not having reviewed this before today. It's one thing to feel like I am being mistreated by a firm that I thought was getting 40%, but now I've come to find out that there is another firm that is getting 20% for running a radio ad that I responded to.
