An IT professional from India came to UK in May 2016 on short term ICT visa that was valid for 1 year. The person was accompanied by wife and son on dependent visa.

They all went back in April 2017 (4 weeks before their visa expiry date), the application was filled before the first visa finished on 15 May 2017 and the new visa was issued from 17 May 2017.

In May 2017 the person came back to UK on long term ICT visa valid for 2 years and was accompanied by wife and son as dependent.

Since then they have been getting the Visa extended in UK (2 years Global Mobility staff in 2019 to 21 and then every year till July 2024.)

In July 2023, my son got admitted in a three years degree course in Glasgow University and filed for Student visa.

In July 2024, the person got a 2 years Skilled worker visa from the same IT company.

My questions:

  1. Is the short term ICT visa of one year (from May 2016 to May 2017) counted for 10 years ILR route? If it's valid in ILR route, and *does the one day gap in visa on 16 May 2017 - will the continuous residence break for 10 years and does the clock count now start from 17 May 2017?*

  2. ⁠My son got a student visa in 2023 for his degree course from Glasgow university and is now in full time employment since September 2025 when he got Skilled worker visa. Can my son apply for ILR in May 2026 or should he wait for completion of 1 year on his skilled worker visa?
