UK based British citizen asked for additional details on a submitted W-8 BEN form for dividends
Hello! My wife is eligible for dividends from an old company she worked for. She is a UK citizen based in the UK. We have both filled in our share of W8 Ben forms in the past, but this is the first time either of us has been asked to add more detail to the submitted W8.
They have said that she will be subject to 30% unless she qualifies for the reduced rate. So far, so good. They state:
"If you confirm that you are eligible for a reduced treaty rate, please resubmit Form W-8BEN, including the treaty country and applicable reduced rate in Part II for W-8BEN."
There's a part on the W8 where they want her to fill in the blanks. My question is, does this look right? (the parts we have filled in are in bold, and bracketed).
"Special rates and conditions (if applicable--see instructions): The beneficial owner claiming the provisions of Article and paragraph [Article 10, paragraph 2, US-UK tax treaty for dividends] of the treaty identified on line 9 above to claim a [15%] rate of withholding on (specify type of income):[dividends]. Explain the additional conditions in the Article and paragraph the beneficial owner meets to be eligible for the rate of withholding: [beneficial owner of dividends]."
Like I said, we've never had to go looking for articles and paragraphs before, so I'm hoping we have this right. Thanks in advance.
