I have been presented with the opportunity to work for somebody who sells things at state and local fairs/markets. The job would entail me going to other states and working for, sometimes, a month at a time in another state. I would have no expenses coming out of my end, boss pays for flights, food, hotel, everything. I would just show up and sell the product.

My question is, would this make me a regular W2 employee? And would I just file my taxes regularly or is there special consideration that needs to be taken for working in different states?

There are a few red flags that I have seen. A friend already works for this person and they just work under the table, boss pays them an hourly rate for their time in cash and that's that. No overtime. Just straight pay on 10-12hour work days for a month. I spoke to the boss and they said that it was up to me how I wanted to go about it and that they are flexible. They said if I wanted to be on the books, as a W2, that they had insurance I could buy into and a 401k plan we could set up. But they also said I could be a 1099 if I wanted, which makes no sense because I have no expenses. Or I could work under the table for straight cash like my friend.

I am a first generation US citizen, I was not born here, things are not looking great right now for anyone not born here, even if you have your citizenship. I don't want to make any mistakes with this. But this could be a really great job for me, it would at least triple my income from what I make now. How do I move forward in the most lucrative and legal route for me? Thanks in advance for reading this and any advice you may have.
