I worry that this is going to flagged as fake or not sincere. I am a real person and this is a true situation. I desperately need the help. I understand the circumstances may sound far-fetched.
My best friend has asked me to try to find resources for her. She is very burnt out and feels hopeless.
Her child was sexually assaulted by a predator that groomed him online and gave him HIV. He was 14 when it happened. The sentencing and trial have been completed. He pleaded to Lewd Conduct and got eight years.
The part that we need to help their family, is that they found out about the HIV diagnosis further into the justice process. The predator had this plea agreement in place but none of it mentions the medical issues caused by the assault. To be very clear, she isn’t wanting to pursue further criminal charges. Her concern lies primarily in that she wants to be able to prove by testing that he DID acquire the HIV from the man who currently is in jail. This is mainly for disability and medication reasons.
The prosecutor tells her this is a civil case. Basically “GOOD LUCK!”
The civil attorneys she had talked to do not want to take this on, and say “this needs to go through the prosecutor”
It’s an endless circle of bouncing this around. How do we approach this? We just want the blood sample to compare the mutations of this disease and see if they’re a match. How would you approach this? What can we do to make sure this child receives medical care into adulthood.
