Discussion regarding several 2A related federal cases
I did a quick search for discussion of these before posting, but found little, so forgive me if this is a repost, but I was curious as to everyone's thoughts on several extremely impactful second amendment related cases currently making their way through federal courts, all with potential to reach the supreme court.
- US V. City of Denver Colorado
https://www.justice.gov/opa/pr/justice-department-sues-city-denver-unconstitutional-weapons-bans
The united states department of justice is suing the city of Denver in an attempt to overturn it's 37 year ban on "assault weapons" based on the precedent set by the Bruen decision, whereby bans on arms in "common use, for legal purposes" are no longer allowed. I'm not a huge fan of the feds telling states and cities what they can and can't do, but I DO believe we all have a constitutional right to an AR, and I think this one has a really good shot at making it to the supreme court, who will, based on Bruen, almost certainly rule in favor of the DOJ. I am not a law scholar, but as I understand it, were that to be the case, it would essentially prevent any state or city from banning "assault weapons" or Ar-15 style rifles in any capacity.
- Jensen V. ATF
https://saf.org/cases/jensen-v-atf/
At the heart of Jensen V. ATF is the question of whether the ATF rules regarding short barreled rifles and suppressors can still be enforced, now that the tax on them has been removed, given that all historical precedent has upheld the rules based on Congress' constitutionally granted powers to levy taxes, and the rules being supports of said levied taxes. This one also seems like it has a good chance at getting to the supreme court, and getting a pro 2a ruling, given that no one disputes the facts of the case prima facia, and that literally ALL previous court rulings upholding the rules relied exclusively on their status as a framework for enforcing and collecting the tax. This would alleviate a boatload of headaches for people that like to tinker with their builds, and honestly, rectify the fact that these rules only exist as a side effect of congress trying to ban handguns all together in the '30s.
- Benson V. US
https://www.nytimes.com/2026/04/23/us/politics/dc-ban-gun-magazines.html
Benson V. US is a case about whether it's legal to ban magazines over 10 rounds. Initially a 3 judge panel in DC ruled that the city's ban on magazines over 10 rounds was unconstitutional, but that ruling has since been reversed, and now the case will be reheard en-banc. If the court rules that magazines over 10 rounds are "arms in common use", as established by Bruen, it would create a circut split with other courts, greatly increasing the likelihood of it appearing before the supreme court. I don't really know how likely that is, but it would be nice as a someone who lives in a state that DOES restrict magazine size to be able to buy guns without having to put a note that says "don't send the mag, I'll get a smaller one myself."
Anyway, just curious as to everyone else's thoughts on these cases, and whether or not ya'll think they have a chance at turning out in a pro-2A way.
