My husband and I moved into our current lease April 16, 2025. Our lease expired April 15th and we informed our current LL (via text, we did not submit an N9) in March that we would be vacating as of May 1st.

Given our lease term is mid month we paid rent in full on March 15th, bringing us to our last month rent deposit covering April 15 to May 15. We were aware this was overpayment but given our lease term being mid month we accepted this and would only ask for money back if our LL found new tenants to move in on May 1st.

Our LL came to inspect our home on Sunday and confirmed new tenants would be moving in May 1st. We asked her about receiving our two weeks rent back and she told us she would consult with her realtor. I asked again today and this is the response I received from her. (Not the first time she has thrown being a lawyer in our face to get her way).

My question is - am I in the wrong? Is what she is saying true and she does not owe us our rent back? I reviewed legislature and had the understanding that it is unlawful to collect rent for the same unit at the same time period for overlapping tenants.

(Was informing her we are keeping possession until the 15th wrong?)
