Edit:
1- She has NOT OVERSTAYED.
2-She’s looking for best advice with no illegal activity but also saves her marriage.
3-They got religiously married a few weeks ago and were awaiting their 90 days mark to do the official marriage required to file for GC.
4- She’s confused if it’s best to stay till next week, file for change of status and then leave or do the official marriage and stay while she’s in processing.
5- The ICE letter gives her till May 17th.
6- Her 90 days in U.S. complete on 12th next week.
7- Will she be able to return ever? Wait times for filing outside the U.S. are like 10 years and so on.
My friend came to the US on a tourist visa with her father. He left as planned, but she stayed because her fiancé is a US citizen and they plan to marry. She just received a letter from ICE saying she failed to leave with her father within her authorized time.
The letter has her correct passport number, her father’s name, a case number, and a control number but we have no idea how to verify those against any official government portal to confirm it’s real.
Questions:
- Is there an official portal to look up ICE case/control numbers?
- Given her fiancé is a US citizen, what are her options?
- What should she avoid doing right now?
Any advice or experience with something similar is appreciated.
