





Not every day that the Appellate Court releases an opinion that says the original Court Martial jury made the wrong verdict and can go pound sand
Short synopsis of the case. Marine gives birth alone and without medical assistance in her barracks room. Baby dies immediately after the birth. Three days later, NCIS interrogates the Marine in English, even though Marine is not fluent in the language. Based on interrogation, NCIS told command there is enough evidence for murder and false official statements. Command commences a General Court Martial against the Marine, who elects trial by Members (jury). Jury finds Marine not guilty for murder, but guilty for involuntary manslaughter and false official statements in her NCIS interrogation. NMCCA says "wrong decision, Members" and then overturns the Marine's conviction and sentence for lack of factual sufficiency.
