Misrepresenting working state [N/A]
Misrepresenting working state [N/A] I am an HR Generalist one month into a new role (5 years experience). It is a small remote company of under 40 employees I was hired on to basically plan to take over for the HR Manager within the year as she plans to leave. (Not widely known throughout the company) She stated many times that she doesn't know how long she'll make it before she resigns or they can just fire her. (She wants of out the 9-5, nothing to do with the job itself).
One of my first tasks here has been a state compliance audit as the registration process in the past as not been consistent. Within this audit, I found out that she has her home address & work address listed as Arizona so we are registered in Arizona. She actually lives and works in California, she brought me out to California for my onboarding week even but has family in AZ. She stated during that time that she doesn't want to open California due to all of its employment laws & taxes. So she is intentionally misrepresenting the company with what state she works out of as the HR Manager.
I also have been running payroll audits, within that audit I found that she has not been utilizing her PTO balance when she has been off. January-May she has used 56 hours in the system but in reality has been off on PTO for over 200 hours based on what she/others has told me & her calendar has listed. She's been out 3 of the 4 weeks since I've been hired as well.
These are the two biggest things I have noticed to be concerned about but there is more. I am nervous since i am new yet & don't want to come off as trying for a promotion but believe ethically as a HR Professional I need to go to the CEO (her boss) about all of this as they are such a compliance risk for the company PLUS we are preparing to sell the company in the next year or so, hence the compliance audits I am running! I have personally been meeting with the CEO already on a weekly basis so I have built a rapport with him.
Would love any insight from other HR professionals!
