Help on accommodation decision

Hey guys,

I got an accommodation offer from Little Hall residence recently, and my offer will lapse on 12th of april. I am currently enrolled to an Exchange program but have not applied to visa yet. In order to complete my accommodation agreement, i must pay 2008 Aud. I am considering the case that i get my visa application refused, and do not get a refund.

In the agreement, it says: If you will not be commencing as a student at The University of Melbourne, you may terminate this Agreement in accordance with this Clause 7.

Would they consider the visa refusal as an reasonable excuse for not commencing and refund the security deposit?

I asked the residence but got this answer: Please refer to clause 7 (Commencing Student Cover) of the agreement for details on what happens with your contract and security deposit in the case that you are unable to attend the University. As there is a strict cut-off date, we recommend applying for your visa as soon as possible to allow for possibly lengthy processing times.

But in clause 7.4 the agreement says: 7.4.2 provide satisfactory evidence to the University that:

7.4.2.1 your University of Melbourne course application has not

been successful; or

7.4.2.2 your University of Melbourne course offer has been

withdrawn; or

7.4.2.3 you have successfully declined your University of

Melbourne course offer.

Otherwise, this Agreement will continue and not be terminated.

None of these cover the case that i am enrolled but not able to attend the university due to visa refusal. I do not know what to do, if i do not accept would i get another offer in May or June? I know this is a long post but it is a little bit complicated and not covered in agreement so i need your help.
