Is it possible to query a book that relies on rights that are held by an estate? Would you go to the estate first or to an agent?

I want to write and illustrate a Silmarillion picture book series (or even just one part) so badly, but if this kind of thing is not publishable at all I would put in on the backburner, post it for free someday when I finally finish. But if there's even a chance, I'd work so hard on that dummy!
