I am posting on behalf of my partner who receives worker's compensation for an accident at work in 2009. He has been receiving payments from Allianz who manage his case since 2019. Just for clarification, he was injured in Victoria but we now in Queensland.
It was recently discovered by Allianz that there was an ABN opened in his name in 2014 by his former partner, which was reactivated in 2025. Allianz emailed last week asking him to clarify why he has an ABN as a sole trader, which he has since clarified he has no idea if even existed until their email. He's also attempted to close the ABN via ATO, but been advised the investigation of the ABN and closure could take months - the ATO have advised that there has never been any activity on the ABN. Allianz have requested proof that the ABN has been closed, which we obviously can't provide beyond telling them what the ATO told him.
They have also requested his tax returns for the last 5 years and all statements from his bank accounts for the last year. While we know that the statements and returns will show he hasn't been receiving any income apart from his workers comp, we are concerned that handing all of his bank and tax information over to them will be an issue. As they have previously (between 2019 and June 2025) continuously communicate with this same person as if they are an authorised representative. This access was never granted by my partner and Allianz now concede they made an error in doing so. This led to further abusive behaviour including attending medical appointments and further identity theft.
My partner has an active DVO against this person due to stalking, serious assault as well as high levels of coercive control including drugging him, theft of personal items and fraudulent activity on his bank and credit card accounts amounting to hundreds of thousands of dollars.
This has been reported to the QPS and apparently has been assigned for investigation, but we've heard nothing.
This person recently also tried to gain unlawful access to email accounts remotely, as well as stalking our house.
We have since moved away from the area completely to escape this ongoing situation.
We've approached a few law firms trying to get some help with this situation it have basically been told they can't help us so far, which we think is because we are in Qld and the WorkSafe claim is in Vic.
I guess the advice we are after is should we hand over the information to Allianz? Also, are there any law firms that would be able to represent my partner if required?
He has severe PTSD, depression and suicidal ideation, and this issue is having a profound impact on these conditions.
