Two tenants live in a building.

Person #1: Has lived in the building for 4 years. Unproblematic tenant. Communicates well and has helped the landlord find other suitable tenants when requested. Trusted and reliable. No noise complaints or issues. Has a good relationship with landlord. This person desires a more coveted apartment that has currently been occupied by other tenants for 4 years. This tenant is notified that said apartment becomes available via communication from the landlord - this tenant expresses keen interest to the landlord via email.

Person #2: Lived in building for 2.5 years. Less considerate of the quiet atmosphere of the building. Plays loud music, slams doors, and is loud at quiet hours. This tenant had also expressed interest in said apartment at some time. This time is unknown.

Landlord tells person #1 that the unit is available via email and asks them for availability to move in and extra details. Person #1 confirms they want the apartment. The landlord says that they might have to check if person 2 wanted it, despite the fact that they haven’t heard back from person #2. When the landlord circled back to person #2 they said they wanted it and the landlord gave the apartment to person #2.

The landlord clearly doesn’t have a system that was communicated to tenants for the process of acquiring a new unit. Agree or disagree?

Should the apartment have gone to person 1 or 2?

If there is no system - should the unit go to: who asks for it first or a more reliable, long term tenant?
