countersue option/cost?

Location: TX
my cousin is a real estate agent. she was showing a house and a client did something dumb and hurt himself (keeping details vague, he put an appendage somewhere he obviously should not have to his regret). he sued her, claiming basically she should have stopped from him being dumb. he eventually dropped the case, but she is still left with several thousand dollars worth of legal fees. could she countersue for damages (basically just to cover the legal fees)? or financially would it make sense to just figure out a way to pay these fees because countersueing would either be unfounded or likely to cost her more fees? she’s understandably very stressed. i don’t really know anything about law and would just like to help her figure out what her options are

My son is unable to take the spot he has in off-campus housing with 4 other sophomore boys. The apartment is 5 bedrooms, fully furnished, on Diamond St (about a block from campus). Rent is $650/month. The lease starts in August, but a deposit is required upon signing and last month's rent is due some time before August (as to be determined by the landlord). If you are interested, please message me!
