Criminal history triggered RFE.

Arrests:

  1. Obscene language or threat to injure- convicted
  2. Restraining order violation
    a. Reduced to disturbing the peace, dismissed after program completion.
  3. Arrested for simple battery on spouse-charges dismissed by DA.

RFE requested rehab evidence.

  1. AA active member for 5yrs.
  2. 1:1 counseling
  3. Victims from arrest 2 and 3 provided support letters to indicate rehab effectiveness.

Positive factors:

  1. Lived in US for 40yrs
  2. US citizen minor children
  3. Volunteer 40hrs to AA per month for intervention
  4. Sober 4yrs

Although the 3rd arrest did NOT lead to a conviction it is understood that USCIS does not care, it’s the behavior that’s concerning.

Likelihood of uncle bob approval of 192?

I applied in July 2017 for assault with a deadly weapon.

The fact is this, I’ve been here all of my life. Been a daca recipient since the beginning of the program. I was 2 when I came to America.

I’ve been arrested a couple of times. Only one arrest lead to a conviction, the other others were dismissed while one of those was a DV arrest which I truly regret.

I’m lost, I haven’t received my U approval/denial. I sent in my RFE that required rehab info. I’ve been a decent human being for the last 10yrs, sober for most of those, active member of AA, volunteer to support and get people clean.

At the end of the day, I can’t blame my victims, I can’t blame my parents, I can’t blame my childhood trauma. It is the cards I was dealt and it is how I decided to play those cards and I will live with my strong conviction that even if you’ve changed, they’re unpaid debts and being potentially denied and removed is one of those debts which I am fine with.

I’ve owned my mistakes, I’ve remedied them, but for whatever it’s worth, I’m deeply grateful I got to experience America, the friends I made, the great people, I’ve come in contact with.
