I’m finalizing my DIY EB-2 NIW petition and hit a roadblock regarding Prong 1 (National Importance) and Prong 3 (Balance). Since I’m an industry professional (8 years in Tech Consulting) with no academic citations, I’m struggling to bridge the gap between "good at my job" and "nationally important."
My Profile:
- Nationality/Education: Canadian with a Master’s in Engineering from a top-tier US school.
- Experience: 8 years in tech consulting/digital transformation.
- Proposed Endeavor: Modernizing US critical infrastructure (Construction, Manufacturing, Semiconductors) via AI-driven ERP and automation to enhance supply chain resilience and industrial competitiveness.
The Evidence Gap: I have 3 letters from "dependent" sources (people who know me/worked with me):
- Former Client Exec: 30+ years exp. Endorsing my impact on Construction & AI.
- Former Mentor (Fortune 500 Sr.Director): Endorsing my work in Aero/Semiconductors.
- Faculty Director (Master's Program): Endorsing academic foundation + industry demand.
My Questions:
- Prong 1 without Citations: For those in industry, how did you prove "National Importance" beyond just your company’s bottom line? I’m leaning on Executive Orders regarding Supply Chains and the CHIPS Act—is that enough?
- The "Independent" Letter: My Faculty Director never taught me, but we had some social acquaintance, so they aren't truly independent? How critical is a 4th, truly "cold" letter from someone who only knows my reputation or results? Can I swap this for "Expert Opinion Letters" from industry bodies?
- National Interest (Prong 3): Since I don't have citations, I’m arguing that my skill set is "rare" and the PERM process is impractical for a consultant moving between critical sectors. Has this worked for others in the 2025/2026 climate?
- Nationality Advantage: Does being Canadian (USMCA ties) or having all US-based references help with the "National Interest" argument for Prong 3?
