Very brief summary:

My husband is a welder, a group of the guys were joking about not wanting to go up on the roof to weld material. In their joking my husband jokingly said he has vertigo as his excuse (they still ultimately go up and weld the material). After this, a couple guys go to the boss and tell the boss my husband says he has vertigo. He has worked here for a year operating heavy equipment, driving for material with his CDL, and welds.

His boss now thinks he is a liability and reduced him to a laborer only (no welding, driving, heavy equipment) and is reducing his pay from $31/hr to $25. My husband went to the doctor and got a doctors note indicating he does not have vertigo and provided that to his boss. His boss said he thinks the note is “not real” but has to accept it- but keeping him at the reduced role and pay.

Is this legal?

Yes my husband tried to explain all the guys were joking around, the boss “doesn’t believe him”.
