Advice on Name Change

My nephew just turned 18 and lives in TEXAS he wants to change his last name due to the cost of hiring a lawyer for something simple we are doing it ourselves. On the form it ask to disclose any felonies or misdemeanors when he was sixteen he got in trouble with the police and got charged with a felony but it was eventually dropped once he successfully completed his probation and classes and his record was SEALED does he still have to check yes and list that information?
