(Scotland) Neighbour'a Camera is Filming My Mother's Property
Hello there, as the title says. My mother phoned me earlier today 10/05/2026 to state that the neighbour's newly installed motion camera follows passerby's and my mother on her own property. The camera strays away from the neighbour's property, following my mother onto her own front garden. So essentially, their property is no longer being recorded.
I have told my mother to politely ask the neighbour to ensure that their camera has a motion zone that does not exceed their own property, if there is any resistance to file a written complaint to her housing company, asking for any data stored on their camera to be sent to her or deleted.
I then received a phone call hours later saying that the neighbour had phoned the police on my mother for showing me what the camera does (essentially show me that the camera follows her around outside of the neighbour's property). The police told her that her neighbours don't have to disclose any information about them recording outside of their premises and that filming outside of their property is okay.
Are there any further steps my mother can take legally? I know of the ICO, but is it just a case of talking to the housing association too? Are there any other routes we go can down?
