So my 14 y.o granddaughter who I’ve raised since she was a baby has been diagnosed with ASD since 18 months-have lived with this a long time and learned quite a bit along the way. She is verbal with ADHD LD but generally does well- (when she gets her assignments turned in)this is her first year in high school. Two days ago, I received a call from the VP informing me that she threw a desk and cussed out the teacher, I was informed that she is being placed in an out of school suspension for 2 1/2 days. I asked if he had read her IEP and was informed that he had not, I then suggested he read it and re-evaluate his decision so that she could return to school the next day. It is documented in her IEP that she is to receive support from her teacher to offer her BASE when she starts to get agitated. In this instance, she was given an instruction to move a desk which she did and then told to move it again- she did not understand why and questioned the teacher who told her she could go sit down if she didn’t want to help, ( my girl interpreted the tone that her teacher was angry and that sitting down was not a true option) so she picked up the desk and slammed it into another desk, teacher told her to “get out and wait in the hallway!” As she walked by the teacher she said “F**k you”.
The VP denied my request to re-evaluate. When I finally was contacted by the case manager I explained what happened and my concerns about her IEP was not followed.
What has happened since yesterday is I have requested a MDR to demonstrate that the incident was disability related and they did not follow her IEP. I was denied that as well- they actually told me that it is her responsibility to ASK for BASE. This was her first outburst because all her other teachers follow the plan. The coordinator had the nerve to tell me this was not ASD related. I want to add that I am a licensed counselor and am very aware of how her ASD works and am no novice to IEPs but up until now we have had decent support from her treatment team. I tried to be collaborative but now I’m so discouraged, I do have a consultation with an attorney today and don’t know what I’ll learn. Has anyone else run up against this? We are also in Texas so I get it’s not the most able-friendly state for ND kiddos. But if anyone could share what they have done I would appreciate the support.
