Would You Leave or Stay? Ongoing Apartment Noise Issues + $8k Concession Repayment
Need some honest opinions because I genuinely don’t know what the smartest decision is at this point.
My partner and I currently live in a newly constructed luxury apartment in Bergen County, NJ, and we’ve been dealing with ongoing structural impact noise issues for a long time now (about 8 months). It’s not just occasional footsteps - it’s repetitive impact noise and vibration transmitted through the structure throughout the entire day. I’ve lived in 8+ different apartments before (older buildings, newer buildings, luxury apartments, etc.), so I completely understand that some level of noise is normal in apartment living. However, this apartment honestly has the worst soundproofing I’ve personally experienced.
We’ve documented the issue with multiple videos, and management has essentially acknowledged that there is very little they can do because it appears to be structural sound transmission. The only thing they can really do is ask the upstairs neighbors to use rugs.
Because our unit also faces the courtyard, we additionally deal with a lot of noise coming from the courtyard itself - especially dogs barking after being left alone on terrace areas facing the courtyard, dogs barking inside apartments with windows open (which echoes throughout the entire courtyard), and people yelling or screaming outside. This has added even more stress to the situation. So unfortunately, it has been a combination of structural impact noise from surrounding units and constant courtyard noise.
The issue has genuinely affected our daily quality of life. We get woken up by noise, hear constant impact sounds throughout the day, and it has become mentally exhausting.
We signed a 2-year lease and received move-in concessions (2 months free; for a 1-year lease, it would have been 1 month free) when we moved in. We’ve been negotiating with management, and the current situation is basically:
* Transfer options are limited because there are no quieter units currently available
* Management may potentially waive the early termination fee or amend our lease end date after speaking with higher-ups
* However, concession repayment would still apply (a little over $8k)
* Another option they offered was providing a 60-day notice and continuing to pay rent until a replacement tenant is secured (with the concession still needing to be repaid)
We’ve already lived here for over a year, which is why paying back the full concession feels difficult to accept, especially since this move-out request is due to ongoing living condition issues rather than simply wanting to move. I understand that a concession is ultimately still part of the lease agreement, but after dealing with this for months, it feels frustrating that the financial burden still falls entirely on us. I also understand the lease contract is straightforward and there may be limits to what management can do, but at the same time, we are not simply trying to break the lease for convenience.
Part of me feels like paying the concession and moving out may be worth it for our mental health and quality of life, but another part of me struggles with the idea of paying that much money over something we genuinely cannot control.
So I genuinely want opinions:
Would you personally pay the concession and leave for your mental health and quality of life?
Or would you try to stay and deal with it for the remainder of the lease?

* Fort Lee
* Englewood
* Leonia
* Teaneck
Needs:
* Ideally within about 15-20minutes (without traffic) from Fort Lee / Englewood / Paramus area
* Decent sound insulation / quieter construction
* Pet friendly (have a small dog)
* Good management if possible
* Budget is flexible at this point because I honestly just want peace 😭
