Hello! EB-2 ROW (Czechia) here, filing from Houston, TX. Here's my situation:
- H-1B expires September 30, 2026
- I-140 approved (premium processing, April 30)
- I-485 filed April 15, 2026 (pending, no biometrics yet)
- AC21 portability kicks in October 13, 2026
- Priority date November 2024, current
My company wants to file the H-1B extension (+2 years) without premium processing. Their logic: there's a chance the green card arrives before September, and if it doesn't, we can always upgrade to premium in August/September and get it approved within 15 business days before expiry.
I'm nervous because of the new USCIS vetting hold - worried both the I-485 and the H-1B extension could be delayed. My company thinks we're fine because we can upgrade to premium at any time.
Are we being too relaxed here? Should I push for premium now, or is the upgrade-later strategy still sound and there's nothing to worry about? Anyone else in a similar situation?
