Do i qualify for shared parenteral leave/ pay through this arrangement?
I currently work 38 hours per week over 4 days in a salaried role earning £54,000 per year.
In addition to this, I also work 2 days per week elsewhere through my limited company, which generates around £1,500 per month in income.
My wife is employed by my limited company on PAYE with a salary of £1,000 per month. Her role includes helping organise work, managing schedules, and handling administrative tasks.
My wife is now pregnant and will need to go on maternity
leave. As her employer through the limited company, I would like to continue paying her appropriately during this period.
After the initial maternity period, I would like to explore whether we can use Shared Parental Leave (SPL), where:
- my wife curtails her maternity leave, and
- I take up to 26 weeks of Statutory Shared Parental Leave/Pay through my main salaried employment.
I would like to understand:
- Whether this arrangement is legally and practically possible.
- Whether my wife’s employment through my limited company qualifies her for Statutory Maternity Pay (SMP).
- Whether I would qualify for Shared Parental Leave and Shared Parental Pay through my main employer.
- Whether there are any issues with continuing to pay my wife through the limited company during maternity leave.
- Whether there are any HMRC, payroll, or compliance considerations I should be aware of.
