My parents lived in a 100 year old house in another state for many decades that they didn't maintain, bought a condo in NY in our building and moved here. The old house is not to code and objectively unsafe. I've been addressing the 1950s electricity, rotting window frames, outside of the house cracking, lead paint, lead in water pipes, structural problems, HVAC, and I have much work ahead.

I made 200k worth of repairs. After my mother died, I transferred their house to me so my father wouldn't be considered a resident of their former state. Then I spent (or committed to spend) 150k in more repairs that are ongoing.

  1. Transferring the house to me does not get added back to his estate because it's located in another state, right?

  2. Do the 150k in post-transfer repairs get added back to his NY estate because the repairs are considered a gift to me? Or do they not count because they are located in another state?

I will consult with a lawyer as well, but I haven't yet because I am considering just moving to CT where I wouldn't have to worry about these issues anymore because the whole situation with the cliff and the add-back is scary.
