Back in December we went to 2 attorneys, my truck ended up getting repossessed so we had to act fast and file before the 10 days was up or we lost the truck.
We live in AR with a family of 4, attorney said we made about 100k and at the time the median was 94k
So fast forward we got put into a ch 13 and a payment of 1400 which was more than what we were paying before bankruptcy.
My hours were reduced from 40 to 32 and have been going on 5 months or so now.
I ask to convert to a 7 but attorney says we still somehow have 2k in excess and I’m not sure where he’s getting that?
He said my checks are only 200$ difference monthly and that’s not true at all, Gross they are about 400 difference each check (800 monthly) and Net about 300 difference. Then he says my wife’s has increased $500 monthly and she hasn’t gotten a raise or anything, not only that but he hasn’t even asked for our paystubs so how would he know this?
Not to mention it took 9 emails and 3 phone calls over 3 weeks to get this bullshit answer. He’s terrible at communicating and I’m not sure what to do.
I thought about dismissing and refilling with another attorney and trying for ch 7 since the median has increased to 97k.
Any info would be appreciated
