How is it that the SMRPG and TTYD remakes exist?

Even to this day, I'm baffled how these two exist in the first place. One has been in copyright hell for decades, and the other has had its series go in a vastly different direction since 2012. You'd think these two would never have a chance to be made, so why is it that they do?

I would include Mario & Luigi: Brothership in here as well, but that series wasn't something as dire has copyright hell or the series losing its original identity. All Nintendo really had to do was find a new development studio, which is precisely what they did.

But beyond all this: what could this mean for the future of these two series? Could it mean that one day, SMRPG will get a proper sequel (Paper Mario 64 was originally thought of as SMRPG2), and that future Paper Mario games will follow in the footsteps of the first two games? The door is now open for these possibilities; let's see if Nintendo goes through that door.
